  1. THE ‘FIND MY NOTARY’ SITE
    1. The website www.findmynotary.co.uk (the “Site”) is operated by N Now Limited, a company limited by shares with company number 9482090 and registered office at 4 Tower Close, Berkhamstead, Hertfordshire, HP4 3NF, trading as Find My Notary (the “Business”). A reference to “we” or “us” is a reference to N Now Limited and the Business. A reference to “you” or “your” in the Terms includes you and anyone who accesses or uses this Site on your behalf.  
    2. This Site is designed to facilitate users to find a Notary Public (“Notary”), Translation Agent and/or Legalisation Agent (“Agents”). These Terms of Use, together with our Acceptable Use Policy https://findmynotary.co.uk/acceptable-use-policy/, Privacy Policy https://findmynotary.co.uk/privacy-policy/ Cookies Policy  https://findmynotary.co.uk/cookie-policy/ and our Accessibility Policy  https://findmynotary.co.uk/accessibility-policy/(together the “Terms”) govern your use of the Site. By or continuing to use the Site you confirm your consent and agreement to the Terms.  
    3. Please note that these Terms of Use do not apply to Notaries or Agents who have subscribed to the Site (an “Associate”). If you are a Notary or Agent and wish to discuss becoming an Associate please contact us at info@findmynotary.co.uk 
  2. WAIVER
    1. The Site is a business directory and does not provide any introductory services or have any involvement in the contract of services between you and Notaries and/or Agents to whom you may be introduced through using the Platform.
    2. We do not make any guarantee as to the legal ability, competence or quality of the Notaries and Agents and/or the services they provide as listed on the Site. We do not warrant the accuracy, quality or completeness of any information sourced from any Notary and contained on the Site (including but not limited to their personal profile). You are responsible for assessing and confirming the suitability of any Notaries for yourself. If you have any concerns regarding the validity and/or accuracy of any information included on the Site then please contact us at info@findmynotary.co.uk .
    3. Should you decide to proceed with engaging a Notary and/or Agent who provides a quote through our Site, you will enter into a separate contract directly with the Notary and we shall not be responsible in any respect for any element of such contract nor liable for any loss or damage suffered by you as a result of this contractual relationship.
    4. We do not guarantee the Site will be uninterrupted or error free. We may take down this Site and/or any of its content at any time.
    5. We may update the Site and the Terms from time to time. It is your responsibility to check the Terms regularly. By using this Site after the Terms have been updated, you are consenting to any amendments.
    6. We do not warrant or guarantee this Site is free from bugs or viruses. You are responsible for taking appropriate measures to protect your accounts, software and devices from viruses and other forms of cyber-attack. We cannot accept any loss or damage that may be suffered as a result of following any links on the Site.
    7. No legal professional privilege applies to any information and no duty of confidentiality arises through your use of the Site. Any information supplied to us can be used as we see fit and no aspect of such data and/or information shall be treated as confidential.
  3. FREE SITE

Use of the Site is free, subject to you complying with the Terms. No charge is made for any information, quotes, review information and/or any other information provided to you via the Site.   

  1. REVIEWS
    1. We allow you and other users of the Site to post reviews for certain Notaries and/or Agents (“Reviews”). We are not responsible for the nature or accuracy of any Reviews. The views of others in any Reviews do not represent our views or values and you rely on the information in any Reviews at your own risk.
    2. You represent any Reviews uploaded or posed on the Site must:
  • be true, accurate and complete to the extent reasonably possible;
  • represent your own views and are not written on anyone’s behalf;
  • not contain any material which is defamatory to any person or organisation;
  • not contain or promote any material which is obscene, hateful, sexually explicit, violent or inflammatory;
  • not promote or condone any illegal activity;
  • not discriminate against any person or group on the grounds of gender, age, ethnicity, nationality sexual orientation, disability or political or religious belief;
  • not promote or condone any illegal activity;

  • not infringe the trade mark(s), copyright, database rights(s), patents(s), design right(s) or other intellectual property rights of any third party;

  • not invade the privacy of, or cause annoyance, inconvenience, embarrassment or anxiety to any person;
  • not misrepresent your identity and/or affiliations or be misleading to others in any way; and
  • not contain any information which is untrue and/or incomplete.

 

    1. We may remove without notice any Reviews which do not, or which we suspect do not, comply with these Terms or which we, acting in our absolute discretion, consider to be inappropriate, unlawful or negative.
    2. You warrant that any Reviews posted by you comply with these standards and you will be liable to us and indemnify us for any breach of this warranty.

 

  1. INTELLECTUAL PROPERTY RIGHTS
    1. We are the owner or licensee of all intellectual property rights in this Site and its content, including without limitation copyright, trade marks, patents, design rights, database rights, confidential information and the right to sue under the laws of passing off and unfair competition anywhere in the world. All rights are fully reserved. You are granted a limited personal licence to use the website and some of its contents as specified in our Acceptable Use Policy https://findmynotary.co.uk/acceptable-use-policy/ 
    2. To the extent that the copyright and/or other intellectual property rights in the content of any Review you provide do not already belong to us, you grant us a worldwide, perpetual, irrevocable, non-exclusive, transferrable, fully sub-licensable license to use, copy, alter, display and create extracts or derivative works from that Review in any media formats and for any purpose, including but not limited to for the purpose or promotion of the Business. You are not entitled to any royalty payments or any other compensation or fee related to any such use of a Review. You waive your moral rights in relation to such a Review to the extent legally permitted.

  1. BLOCKING ACCESS AND CONTENT

If you fail to comply with any of these Terms or use this Site or its contents in any manner which we, acting in our absolute discretion, consider inappropriate we may remove your Reviews and/or block your access to this website immediately and without notice.

  1. INAPPROPRIATE CONTENT

If you believe any content of this Site is illegal, offensive, inappropriate, breaches the rights of any person or organisation or breaches the provisions of these Terms, please let us know by contacting us as directed in the ‘Contact Us’ section below. We will review any such notices and take such action as we, acting in our absolute discretion, determine is necessary or appropriate.

  1. LIMITATION OF LIABILITY
    1. Nothing in the Terms limits or excludes our liability for death, personal injury, fraud, fraudulent misrepresentation or any other liability which cannot be limited or excluded under applicable law.
    2. Subject to the above, we exclude liability in contract, tort, negligence, misrepresentation or otherwise for any loss or damage arising from or connected with the Terms. Except as expressly set out in the Terms all conditions, warranties and representations made by the Site and/or any third party website to which it links are expressly excluded. We shall not be liable for any loss of profits, sales, business or revenue or any other economic loss. In particular, we are not liable for any claims, losses and/or associated costs arising directly or indirectly out of or in connection with (but not limited to):
  • the unavailability or lack of functionality of this Site;
  • the accuracy of any content of this Site or any third party website; or
  • any virus, distributed denial-of-service attack or other technologically harmful material which may infect your device(s), equipment, software, programs, website(s), application(s) or other proprietary material as a result of your use of this Site, downloading any content from this Site or any linked website and/or visiting any website via a link from this Site.

 

    1. Subject to any express limitation or exclusion of liability in the Terms, our liability to you is limited in aggregate to £250 for all matters concerning or arising out of your use of the Site. This aggregate limit reflects the fact information is made available to you for free.
  1. INJUNCTIVE AND EQUITABLE RELIEF

We may seek injunctive and/or other equitable relief against you in any jurisdiction worldwide for any breach of these Terms.

  1. THIRD PARTY RIGHTS

A person who is not a party to the Terms shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision in the Terms.

  1. APPLICABLE LAW AND JURISDICTION

These Terms are governed by English Law. Subject to our right to seek injunctive or equitable relief as stated above, you agree to submit to the exclusive jurisdiction of the Courts of England in relation to any claim or dispute arising out of or in connection with these Terms.
